Family Based Immigration / Green Card

If they meet specific criteria, family members of American citizens or legal permanent residents may be eligible to apply for lawful permanent residency (often known as a "green card"). Before filing a petition for a family member, there are a number of things to take into account, such as whether the procedure will be finished in the United States or abroad, how long and expensive it will be, and whether waivers will be required.

Naturalization

The procedure by which a legitimate permanent resident can become a citizen of the United States is known as naturalization. You can be qualified to apply for naturalization if you have been a legal permanent resident for at least 5 years (3 years if you are applying as the spouse of a citizen of the United States). We can help you figure out if you're a good candidate for naturalization.

Citizenship Through Parents

When a person is born outside of the country, they can get citizenship through their parents at birth or before they turn 18. Congress has frequently changed the legislation governing acquired and derivative citizenship over the years. Because of this, citizenship law can be very complicated. Our skilled lawyers can examine your situation and advise you on the best line of action. We can also help you with obtaining a Certificate of Citizenship or obtaining a U.S. Passport.

DACA

Individuals who entered the United States unlawfully as children, and who meet certain conditions, may be eligible to receive protection from deportation with the Deferred Action for Childhood Arrivals (DACA) program. DACA is granted for a period of two years, and is subject to renewal.

You may be eligible for DACA if you:

  • Were under the age of 31 as of June 15, 2012;
  • Came to the United States before reaching your 16th birthday;
  • Have continuously resided in the United States since June 15, 2007, up to the present time;
  • Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;
  • Had no lawful status on June 15, 2012;
  • Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  • Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.
